ALBUQUERQUE, N.M. – Prosecutors say the case against former actor Timothy Busfield should move forward after his lawyers asked a judge to throw out the indictment.
That was the main point of the state’s response to Busfield’s motion to dismiss the grand jury indictment against him.
Prosecutors say Busfield had enough time to testify before the grand jury and that they did not withhold vital information.
Busfield faces accusations of sexually abusing two boys while working with them on a TV show filmed in Albuquerque.
His defense argues the case is unfair and lacks evidence.
The defense also claims the state broke grand jury rules by withholding evidence, including an independent investigation that found no evidence of misconduct.
A judge will decide whether the indictment stands or whether the court dismisses it.
