LAS CRUCES, N.M. — Kimberly Skaggs, the former treasurer of the Republican Party of New Mexico, filed an appeal to be released from jail as she awaits her trial for a deadly hit-and-run crash.

Skaggs’ attorneys argued the judge made a procedural error when ruling to keep her in jail until her trial. They argue she isn’t a threat to society and should be released.

Investigators allege Skaggs hit and killed the man earlier this month in Las Cruces. Prosecutors say she then left the scene. Skaggs is accused of changing the license plate on her car and hiding the car at another property after the crash.

At the time of the crash, Skaggs was the treasurer of the state Republican Party. Shortly after the accusations came to light, the party said she was no longer affiliated with them.

Skaggs faces a wrongful death lawsuit from the family of the man killed in the crash.

A trial date has not been set.
