LAS CRUCES, N.M. – An appeals court ruled Kimberly Skaggs must stay in jail as she awaits trial in a deadly hit-and-run case.

Kimberly Skaggs, the former treasurer of the Republican Party of New Mexico, asked to be released from jail while she waits for trial.

Her attorneys argued the judge made a procedural error when the judge decided to keep her in jail until trial. They also argued she is not a threat to society and should be released.

Investigators allege Skaggs hit and killed a man earlier this month in Las Cruces and then left the scene.

Prosecutors say Skaggs changed the license plate on her car and hid the car at another property after the crash.

At the time of the crash, Skaggs served as treasurer of the state Republican Party. The party later said she was no longer affiliated with it.

Skaggs also faces a wrongful death lawsuit from the family of the man killed in the crash.

A trial date has not been set.
