Unlike a public holiday—which grants paid time off without the need to make up the hours—a “non-working day subject to compensation” requires that the hours not worked be made up later. In the private sector, implementing this measure requires an agreement between the employer and the employees; if no such agreement is reached, the employer makes the final decision.

A visit of spiritual, historical, and social significance

The decree—signed by President Keiko Fujimori, Prime Minister Luis Galarreta, and Minister of Labor Juan Sheput—states that the Pope’s visit, scheduled for November 11–16, 2026, is an event of particular spiritual, historical, and social significance for the country.

It further notes that the measure is intended to make it easier for people to attend events and gatherings associated with the visit.

How will the hours not worked be made up?

Regarding the recovery of hours not worked, in the public sector, these must be compensated for within the following 10 days, or at a time determined by the head of each respective entity. In the private sector, the agreement between the employer and the employees must specify how the hours will be made up; in the absence of a consensus, the decision rests with the employer.

Essential services

The regulation also mandates that public entities within the specified jurisdictions take the necessary steps to ensure the continuity of public services essential to the community during these non-working days.

Likewise, private companies engaged in economic activities of particular importance to the community may designate specific job roles to be exempted from this measure.

This includes healthcare and sanitation services, cleaning and waste management, as well as the provision of electricity, water, sewage, gas, and fuel. funeral services; communications and telecommunications; transport, fishing, ports, airports, and land transport terminals; lodging establishments that receive and accommodate guests; restaurants; security, custody, and surveillance; financial system entities and other financial services; transport of valuables; and the sale of provisions and food.
