Benghazi – Abdelbaset Bou Janah, head of the Medical Insurance Authority, stressed the importance of malpractice insurance as a mechanism to protect patients and ensure their right to compensation when medical responsibility is established. He said it also protects doctors and medical professionals from financial consequences related to professional liability.

Bou Janah explained in a statement to the Libyan News Agency that proven medical errors can cause serious harm beyond treatment costs. These can result in disability, organ loss, or death, causing material and moral damage to patients and their families.

He said an institutional insurance system provides a clear mechanism for addressing and compensating damages. This relieves citizens from lengthy, direct disputes with doctors or healthcare providers.

Bou Janah clarified that insurance does not mean that every medical complication is considered a mistake, nor does it make physicians responsible for every unfavorable treatment outcome. Responsibility is linked to proven professional errors and breaches of scientific or professional standards, taking into account the circumstances and available resources.

He noted that insurance protection covers doctors, nurses, technicians, and other medical and related professions. He said professional liability may involve more than one party during healthcare delivery.

Bou Janah pointed out that medical insurance in Libya is based on existing legal foundations. He cited Medical Liability Law No. 17 of 1986, which requires medical and associated professions to carry liability insurance. The Medical Insurance Authority is also tasked with covering civil liability for death, injuries, and material and moral damages resulting from medical errors.

He emphasized that developing the medical insurance system and strengthening the authority’s role will help clarify responsibilities, safeguard patient rights, protect healthcare workers, and build trust in the healthcare system.
