MOH introduces new rules for medical staff resignations, terminations

The Ministry of Health has implemented updated procedures governing the resignation and service termination of medical professionals, including physicians and dentists, to enhance administrative oversight and ensure all legal and regulatory requirements are properly met.

Undersecretary of the Ministry of Health Sheikh Dr. Salman Al-Sabah has issued an administrative decision approving a unified form to verify whether medical staff members seeking resignation have any ongoing administrative or technical investigations.

The new procedure aims to ensure that all necessary legal and regulatory steps are completed before approving resignation requests, while safeguarding the rights of both healthcare professionals and the ministry.

According to the decision, the approved form will include details about the medical professional’s employment status and will be reviewed by relevant authorities, including the hospital or department concerned, the Medical Liability Authority, and the Legal Affairs and Investigations Department.

The verification process is intended to confirm that there are no pending administrative or technical investigations before completing the resignation procedures.

The decision takes effect immediately and replaces any previous instructions that conflict with its provisions. All concerned departments have been instructed to implement the new procedures within their respective areas of responsibility.

The move is based on provisions of the Civil Service Law and regulations, as well as Law No. 70 of 2020 concerning the practice of medicine and related professions, patients’ rights, and healthcare facilities.

The Ministry said the updated procedures are aimed at improving administrative efficiency, enhancing transparency, and ensuring that the service termination process for medical personnel is carried out within approved legal frameworks.
