The European Commission is considering legislation to harmonise online hate offences using an existing EU criminal-law power, Gript has learnt, in a move that would remove Ireland’s veto over the matter.

The workaround relates to a 2021 attempt by the EU to add hate speech to the list of areas in which the EU can legislate under Article 83(1) of its governing Treaty on the Functioning of the European Union (TFEU), listing specific crimes the bloc has competency over.
