LAFAYETTE, Ind. (WISH) — A review board has determined that the actions of two officers involved in a deadly shooting in May were within Lafayette Police Department policy.

The Lafayette Police Department said officers were called to 2800 Ravenwood Court to help a woman and her teenage son safely leave their home.

Ernestine Black called the Lafayette Police Department to help her flee from her husband, Kenneth Smith, after what the department calls a “domestic dispute.”

“I’m leaving home,” Black told the 911 operator. “I want to have no problem with my husband.”
“Okay,” the operator said. “So is it a domestic issue that’s going on?”
“Yeah,” Black confirmed.

In a whisper while standing outside of the home, Black told police that her husband was drunk, asleep and armed inside.

Police escorted Black back into the home to retrieve her son and essential possessions.

Once police and Black entered the home it was apparent the man was awake.

An exchange about Black’s desire to leave the home was heard audibly on the camera.

“I’m not coming back,” Black said to her husband.
“You’re not coming back?” Smith questioned.
“No!” Black said.

Black left the bedroom and shortly after this exchange Smith fired multiple times in the direction of the two officers, his wife and the teen.

Only one officer returned fire because of the positions they were in at the time.

Smith was killed during the shooting and pronounced dead on scene.

The Lafayette Police Department said it followed all protocols after a police shooting and both officers were cleared.

The department on Friday afternoon posted details, including audio and bodycam video, on its YouTube page.
