Why Me TikTok videos are not AI, Court hears.

BEFORE viewing a series of video clips in which Tiktoker Francis Kapwepwe, alias Why Me, is heard uttering alleged hate speech, the court heard that the videos were not Artificial Intelligence (AI)/ generated.

Zambia Information and Communication Technology Authority (ZICTA) director of Infrastructure and Resilience Nawa Simatebele testified that detection tools should that the extracted clips where verified not AI generated.

Magistrate Idah Phiri later viewed five Tiktok and Facebook video clips showing businessman and Tiktoker uttering alleged hate speech.

Earlier, Mr Simatebele said the eight clips were extracted from social media platforms.

There were 11 videos allegedly linked to the suspect which were subject to investigations by the police, who engaged ZICTA.

“These are 11 videos, and after searching online, I only identified eight of corresponding videos listed on page 27 of the report [presented in court].

“Having downloaded the same videos, then then proceeded to download the videos from TikTok and Facebook using the forensic tool…

“Police had requested our office to assist to extract and authentic the videos requested” Mr Simatebele said.

In the alleged hate and tribal speech clips, the accused mentions the people of Southern Province, Vice-President Mutale Nalumango, President Hakainde Hichilema, ex-vice President Nevers Mumba, Chief Mukuni and others.

The court also heard that Mr Simatebele also extracted some information from a Samsung Galaxy and an iPhone 15 pro- submitted to ZICTA by police, beyond to Mr Kapwepwe.

“They also requested that I extract data from recovered phones, including WhatsApp messages and social media related accounts”.

The witness said using a forensics software, it was discovered that a device under probe had a Tiktok account in the name -Why Me:The Lion of the World.

Kapwepwe, who was sitting in court appearing humble, is charged with three counts expressing or displaying hatred, ridicule or contempt against persons on the basis of race, tribe, place of origin or colour.

The offences were allegedly committed on different dates in March and April, 2025.
