Trio distances self from murder, robbery charges

Erastus Mwalipeni Gabriel (41), Iyambo Nicodemus Hango (23) and Abast Nyanyukweni Alex Muya (28) this week pleaded not guilty to a charge of murder, two counts of robbery with aggravating circumstances, and a charge of defeating or obstructing the course of justice. The charges are in connection with the three accused allegedly brutally attacking and killing Stanley Sebastia Cloete at his apartment, before fleeing off with his vehicle on 2 March 2024.  The State alleges the three tied up Cloete, stabbed him with a sharp object, stole items valued at N$69 000 and a vehicle valued at N$70 000. Muya and Gabriel gave no plea explanation, while Hango admitted that he stole items belonging to Cloete but denied being involved in his murder. The matter continues.

Murder accused wants procedural fairness

Murder accused Theodor Shipanga, during the continuation of his trial this week, raised concerns about the State not complying with constitutional and procedural principles in the prosecution of his trial. He stated this during the testimony of State witness Eric van de Walt, the manager of the security company where Shipanga was employed before the incident. The accused claimed that the witness statement or the evidence used in questioning the witness, was wrong and that it had been cancelled from being used as evidence by a judge. 

He also disputed the evidence of the witness that pertained to that the uniform found near the vehicle where his colleague, Shain van Wyk, had allegedly been killed by him, belonged to him. Shipanga faces multiple charges in relation to the death of Van Wyk on 11 November 2011 while they were transporting a cash-in-transit vehicle back to Windhoek.
