TSR jawan gets life imprisonment for 2013 firing that killed two colleagues

Agartala: A court in Tripura’s Dhalai district on Monday sentenced a Tripura State Rifles (TSR) jawan to life imprisonment for opening fire at a security post in 2013, killing two of his colleagues and injuring several others.

The Sessions Judge’s Court at Ambassa convicted Bijoy Debbarma (47), son of Manindra Debbarma of Khasiapunji under Salema police station, in connection with the firing incident at a TSR post in Tankarai under Longtharai Valley subdivision.

Court officials said the accused was found guilty under Section 302 of the Indian Penal Code and sentenced to rigorous imprisonment for life along with a fine of Rs 10,000. In default of payment of the fine, he will have to undergo an additional six months of rigorous imprisonment.

The court also sentenced him to 10 years of rigorous imprisonment and imposed a fine of Rs 5,000 under Section 307 of the IPC. Failure to pay the fine will result in an additional three months of imprisonment.

In addition, the court awarded seven years of rigorous imprisonment and a fine of Rs 5,000 under Section 201 of the IPC, with an additional three months of imprisonment in case of default. The accused was also sentenced to three years of rigorous imprisonment and fined Rs 2,000 under Section 27(1) of the Arms Act. In case of default, he will have to serve an additional 15 days in jail.

All the sentences will run concurrently in connection with Sessions Trial (T-1) 18 of 2014 arising out of Chawmanu police station case number 02 of 2013.

According to the prosecution, the incident occurred on January 28, 2013, at around 5.10 p.m. when the accused, then serving as a TSR rifleman, allegedly opened indiscriminate fire using his 7.62 mm service self-loading rifle at the Tankarai TSR post.

Six TSR personnel sustained bullet injuries in the firing, of whom two died on the spot.

Police officials said the case was investigated by Sub-Inspector Udhyam Debbarma of Chawmanu police station, who later filed the chargesheet against the accused on February 10, 2017. The trial concluded with the court delivering its verdict on Monday.
