Another case involving disbarred lawyer

Disbarred female attorney-at-law Brenda Wardally-Beaumont could be back in court shortly to face a high court judge following an action taken out against her by a sister.

THE NEW TODAY understands that the case involved a court ruling against her in a matter brought by her sister in connection with the alleged forgery of the sister’s signature to mortgage a piece of land in Mt Parnassus in the St George North-east Constituency.

The land was repossessed by the bank and the court ordered Wardally-Beaumont to pay her sister for the loss.

A source familiar with the case said that the sister who is represented by a London-based female attorney-at-law is bent on getting the disgraced former lawyer to honour the court ruling.

He said the sister has instructed the lawyer to remind Wardally-Beaumont to pay up first and then we’ll go for a committal to prison if she does not pay.

The sister is also said to be upset with an earlier court ruling in the ex-lawyer’s favour involving a family home.

“There was another case (about) the downstairs of the family home which went in her (Wardally-Beaumont) favour (as the) judge set aside both our client’s version of their mother’s will and her version and went by an earlier one which gave her the downstairs to use as an office and keep,” he said.

According to the source, the sitting Judge accepted the ex-lawyers version of the will although the sister held on strongly to the view that it “was dodgy”.

He said that Wardally-Beaumont is putting forward the argument that she has no money to honour the order given by the court for her to compensate the sister for her losses on the mortgage.

He pointed out that the lawyer for the sister has put forward the counter argument that the disbarred attorney-at-law surrender the office as part of the settlement in the case won in the Mt Parnassus matter.

The source told THE NEW TODAY that Wardally-Beaumont is expected to receive a letter in the next few days giving her “a final 21 days to pay” in keeping with the Court Order or be subjected to an application to commit her to prison.

He said that she should consider herself “lucky” not to have received “a final warning” before because she had changed her email address and the Process Server said he could not find her office.

However, he added that a local law firm who is working along with the English-based attorney-at-law has reportedly retained someone who will serve the papers on her in the next few days.

Wardally-Beaumont has been permanently banned from legal practice due to professional misconduct involving the misappropriation of a client’s funds.

In November 2022, High Court Judges Raulston Glasgow and Victoria Charles-Clarke ordered that her name be struck off the court’s roll.

Key details regarding the case:

  • Misconduct: She was found guilty of professional misconduct for failing to return EC$304,419.99 (held in trust for her client, Joel Ganpot) which represented monies from a divorce settlement.

The case spanned many years, originating from a 1999 client engagement, with the funds received in 2005, and the final decision to disbar made in November 2022.

The court ordered Wardally-Beaumont to repay all outstanding monies with accrued interest to Ganpot.

It was the first time in over 40 years that a Grenadian attorney was struck off the roll for professional misconduct.
