Magistrate M. Sowe of Kanifing Magistrates’ Court on Thursday 24th July, granted bail to Sulayman Touray who is charged with stealing contrary to the laws of the country.

According to the prosecution officer, the accused sometime around the month of July 2025, at the Bakoteh Housing Estate in the kanifing Municipality unlawfully took a refrigerator valued at D13,000.00 (Thirteen Thousand Dalasis), which was the property of one Abdoulie Jallow, thereby committing an offence under the criminal laws of The Gambia.

When the charges were read out to Mr. Touray, he pleaded “not guilty”. At that stage, the prosecution made an application for an adjournment to call prosecution witness to testify in support of the charge.

After reviewing the facts presented and the applicable legal provisions, Magistrate Sowe held that the offence was bailable under the Criminal Procedure Act 2025 and pursuant to Section 24(3) and Subsection 19(1) of the 1997 Constitution of The Gambia. Consequently, the court granted bail to the accused under specific conditions. The bail conditions required the accused to enter into a bail bond in the sum of fifteen thousand dalasis(D15,000.00). Additionally, the accused was required to provide one Gambian surety who must swear to an affidavit of means in the same amount. The surety is further required to deposit a valid Gambian identification documents with the court registrar. Full disclosure of the surety’s residential address, including street and compound information, along with contact details, must be provided and subsequently verified through a recognized GSM operator. Furthermore, the surety assumes full responsibility for ensuring the accused’s appearance in court. In the event that the accused fails to appear, the surety shall be held liable and treated as if he or she was the accused.

Magistrate Sowe then adjourned the matter to Monday, 4th August 2025, for the continuation of proceedings and the testimony of the prosecution witness.
