Murder accused Apisai Madigibuli’s third bail application has been denied by the Suva High Court.
Madigibuli, accused of the murder of his pregnant wife in April last year, appeared before Judge, Justice Dane Tuiqereqere this morning.
While denying bail, Justice Tuiqereqere says the accused must show change in circumstances to justify bail.
The Judge adds Madigibuli’s reasons for bail, which includes allowing him to look after his daughters are not new.
The accused opted to represent himself and told the court that he needs a phone and internet to prepare for trial.
He told the court in terms of fairness; he should also be granted the privileges available to the State.
Justice Tuiqereqere rules that as for the difficulties the accused will face with limited resources in remand, that is the result of the choice Madigibuli has made.
The court rules that Madigibuli remains a risk to the community if bail is granted and raises risk of abscondment.
Justice Tuiqereqere adds that he is concerned about the safety of the victim’s family in light of the savageness of the murder.
The matter is fixed for trial in April next year.
