Farmer’s TikTok case faces review

A hearing next month will determine whether the case of a farmer accused of insulting the modesty of Information Minister Lynda Tabuya on social media should remain in the Magistrates Court.

Lui Bale Vuibereta appeared before Chief Magistrate Josaia Waqaivolavola in the Suva Magistrates Court yesterday.

Mr Vuibereta allegedly posted a live TikTok video on September 1 in Nadi during which he used vulgar language with the intent to cause harm to Ms Tabuya.

A psychiatric examination conducted earlier this year at St Giles Hospital found him fit to take a plea.

During proceedings, the question of jurisdiction was raised by Mr Waqaivolavola based on the jurisdiction principle.

He sought submissions from both parties on whether the matter should remain in the lower court or be transferred to the High Court.

Mr Waqaivolavola is to make a ruling before Mr Vuibereta takes his plea.

Meanwhile, prosecutor Bhavna Kantharia provided additional disclosures, including a transcript of Mr Vuibereta’s video recorded caution interview.

Mr Vuibereta’s bail was extended, and the case adjourned to December 10.
