The federal immigration agents who shot Marimar Martinez five times in October had said minutes earlier that it’s “time to get aggressive” before swerving their patrol car into the Chicago teacher’s vehicle and opening fire, according to newly released body camera footage of the three Border Patrol agents.

A judge released the footage from one of the agents on Wednesday after a months-long court battle to release evidence in the Department of Homeland Security’s now-dissolved criminal case against the 30-year-old woman. Martinez said she wanted the federal court to release the government’s evidence so that the public could see how DHS lied about her case.

According to the footage, two of the agents already had their guns drawn inside their car while driving through the city’s South Side. Driving next to them, Martinez begins honking to alert the area of Border Patrol’s presence while another car does the same, driving behind the agents.

“Do something, bitch,” one agent is heard saying, before another says, “It’s time to get aggressive and get the fuck out.”

Border Patrol had previously claimed that agent Charles Exum, the driver in Wednesday’s video, shot Martinez because she rammed into their unmarked car. The accusation led to DHS pressing charges against Martinez and calling her a domestic terrorist.

But the new bodycam footage shows that it was Border Patrol and not Martinez who rammed their car. An agent in the video is heard voicing intent to hit something, saying, “We’re gonna make contact and we’re boxed in.” Exum then swerves a sharp left into Martinez’s car before jumping out and immediately firing five gunshots.

Martinez survived the encounter while the agents and their bosses — including former Border Patrol Commander Greg Bovino — celebrated the shooting, according to text messages that were released alongside the bodycam video. While DHS eventually dropped the case against Martinez, the agency has yet to retract its lies about the U.S. citizen and Montessori teacher.

“It’s the playbook,” Martinez’s lawyer, Chris Parente, told CNN. “What do you think the next guys are gonna do? They want to be the shooters.

“The reason they’re not helping Ms. [Renee] Good while she’s bleeding out on the streets of Minneapolis is because they’re checking their phones to see if Bovino has emailed them offering them something,” he continued. “It’s disgusting and it will not change until the American people say, ‘Enough is enough, and we want accountability from our elected officials.’”

Exum has been placed on administrative leave while Border Patrol investigates the use-of-force incident, DHS said.

Martinez and Parente are now pursuing a complaint against DHS under the Federal Tort Claims, the first step towards filing a civil lawsuit for damages from the shooting. The Chicagoan also testified before Congress earlier this week about immigration agents using force against the public.

“Marimar is gonna continue to fight because she’s one of the few people who survived these bullets,” Parente told CNN. “Unfortunately, these guys are excellent marksmen and they’ve been able to kill Ms. Good, they’ve been able to kill Mr. [Alex] Pretti, they killed Silverio Gonzalez here in Chicago.”
