DPP Withdraws Murder Charge Against Duo

The Office of the Director of Public Prosecutions (DPP) has decided to drop the case against two men who were implicated and charged for the shooting death of a pregnant Cedar Grove woman.

The murder charge has been withdrawn against Jason Millette and Shalom Bailey, who were jointly charged with Dorian Marshall for the shooting death of Xavier Thomas.

Last week, the Court of Appeal quashed the 40-year prison sentence of Marshall, who had already served just over five years of his sentence.

During the initial trial in which Marshall was found guilty of murder, the jury was unable to reach a unanimous verdict against Millette and Bailey. They were expected to be retried. However, considering the Court of Appeal ruling as it pertains to Marshall and they were jointly charged, the crown decided to discontinue the matter.

The Court of Appeal had also set aside Marshall’s sentence and there was no retrial ordered.

Millette, Bailey and Marshall were alleged to have been involved in a drive-by shooting incident which took place on August 18, 2017, during which Thomas was shot and later died.

Lorne “T I” Nicholas and Shane “Trooper” Matthew were also injured during the incident
