BISMARCK, ND (KXNET) — Here are this morning’s top stories and weather with KX News On The Go.
After five days of trial and three-and-a-half hours of deliberation, jurors handed down their verdict for Delon Davis, for the murder of Mark McMillian in Minot. Jurors found Davis guilty of murder. They also convicted him of tampering with evidence, unlawful possession of a firearm by a felon, and lying to law enforcement. Mark McMillan was reported missing in April of 2024. Three months later, his body was discovered, wrapped in a plastic air mattress in the basement of a business downtown. Authorities say Davis and McMillan had a dispute related to stolen narcotics. Davis testified in his own defense. Jurors also had the option of convicting Davis on lesser charges — manslaughter or negligent homicide. District Court Judge Douglas Mattsen ordered a pre-sentencing investigation. A sentencing date has not yet been set. The maximum sentence for an AA felony murder conviction is life in prison without the possibility of parole.

A man who was facing trial for sex crimes involving a 10-year-old girl in Bismarck has now pleaded guilty. In a Mandan courtroom on Thursday Isiah Simms pleaded guilty to gross sexual imposition. Simms was facing up to life in prison after investigators say he sexually assaulted a girl on the State Capitol grounds in August of 2024. And on Thursday, Simms agreed to an amended plea. A judge ordered a pre-sentence investigation for Simms. He’ll be sentenced in court on September 15.
A top candidate for Minot’s next police chief has withdrawn from the running — and his reason is raising eyebrows. City Manager Harold Stewart initially announced there were four finalists for the job, at Monday night’s city council meeting. But by Tuesday, only three names were publicly shared. After submitting an open records request, KX News uncovered why: The fourth candidate, Richard Rosell, dropped out — citing concerns over a city council member’s involvement in the investigation that led to the resignation of former Police Chief, John Klug. In an email to the consulting firm hired by the city, Rosell said he came across information online over the weekend that changed his mind about running.
