The way has been cleared for the holding of the General Election in Grenada tomorrow, 5 November 2026.
This follows the ruling of Her Ladyship the Honourable Madam Justice Agnes Actie, High Court Judge, this morning in the claim brought by Cajeton Hood against the Prime Minister of Grenada, the Supervisor of Elections and the Attorney-General of Grenada.
The effect of the Claim made by Hood was to stop the Prime Minister from advising the Governor-General to dissolve Parliament and to further stop the holding of the General Election.
Madam Justice Actie ruled that the Prime Minister acted in accordance with the Constitution and the law when he advised the Governor-General of Grenada to dissolve Parliament, and the Governor-General did indeed dissolve Parliament on 2 October 2026. In dissolving Parliament, Her Excellency set the General Election for 5 November 2026. The judge rejected the claim of the Claimant that the Prime Minister acted unconstitutionally.
Madam Justice Actie pointed to the settled law that once Parliament is dissolved and the election process is triggered, any question regarding the General Election must be brought by way of Election Petition after the election is held.
The Claimant Cajeton Hood represented himself. The Prime Minister and the Attorney-General were represented by the Office of the Attorney-General, Dr Francis Alexis KC, Ruggles Ferguson KC and Ian Sandy. The Supervisor of Elections was represented by Darshan Ramdhani KC and Sabrita Khan-Ramdhani.
