AI Could Expose Hidden Mismatches in H-1B Filings

US immigration authorities could increasingly rely on artificial intelligence tools to detect inconsistencies across immigration filings, placing greater importance on the accuracy of records maintained by H-1B visa holders and their employers.

A release from law firm Womble Bond Dickinson warns that AI-assisted reviews could help immigration officials identify mismatches between an employee’s reported residential address and the worksite information provided by an employer in an H-1B petition.

One example highlighted by the firm involves an employer filing an amendment to an H-1B petition to reflect a change in work location after the employee has already submitted an AR-11 change-of-address notification to US Citizenship and Immigration Services (USCIS).

The reverse situation could also raise questions. An employee may move to a new residence but fail to submit the required AR-11 notification, creating a possible inconsistency between government records and the employee’s actual circumstances.

According to the firm, such discrepancies are the kind of issues AI tools may be able to identify by comparing information across multiple immigration filings.

Why Consistency Matters

The issue is especially relevant for H-1B professionals who work remotely or move homes while continuing in the same job.

A residential address change and a change in the authorised place of employment are separate matters, but information relating to both may appear in immigration records.

Form AR-11 is used to report a change of address to USCIS. Separately, employers may need to file an amended H-1B petition when there is a material change in employment conditions, including certain changes in worksite location.

This means employees and employers should not assume that updating one record automatically satisfies the requirements for the other.

For example, if an employee working remotely moves to a different area, the employer may need to determine whether the new location falls outside the area covered by the existing Labour Condition Application (LCA). Depending on the circumstances, a new LCA and an amended H-1B petition may be required.

AI Could Link Information Across Filings

The broader concern is that immigration applications may increasingly be reviewed as part of a larger record rather than as isolated filings.

AI-assisted analysis could allow officials to compare information from earlier and current applications, potentially identifying differences that might otherwise be difficult to notice through manual review.

For Indian professionals, who make up a significant share of H-1B visa holders, this makes consistency across address notifications, employment details and previous immigration filings particularly important.

Differences in dates, job locations or other information may require an explanation, even when they result from administrative mistakes rather than deliberate misrepresentation.

However, the presence of a discrepancy does not automatically mean that fraud or an immigration violation has occurred. The surrounding circumstances and supporting documents would remain important in determining the seriousness of any inconsistency.

What Employers and Employees Should Do

Employers sponsoring H-1B workers should review their procedures for tracking residential moves, changes in work locations and amendments to employment petitions.

Employees should also inform their employers promptly about relevant changes and ensure that required address updates are submitted to immigration authorities.

Reviewing earlier immigration filings may also help identify inconsistencies that should be corrected or explained before a future extension, amendment or other application is submitted.

The key message from Womble Bond Dickinson is that, as AI-assisted immigration reviews become more advanced, maintaining accurate and consistent records will become increasingly important for both employers and foreign professionals.
