Man accused of murder over green chile enchiladas to be held in jail until trial

ALBUQUERQUE, N.M. – A judge ordered Ervin Gutierrez to be held in custody after police said he shot and killed 25-year-old Nathaniel Cavazos after a fight over green chile enchiladas.

The judge ruled Friday that Gutierrez will remain jailed as the case moves through court.

Gutierrez faces an open count of murder in the killing of Cavazos.

Investigators said Gutierrez and Cavazos were at an apartment drinking and eating dinner when an argument about the heat of the green chile on the enchiladas turned into a physical fight.

Police said the fight ended and Gutierrez then pulled out a handgun and shot Cavazos several times, killing him.

Family members of Cavazos said they were not ready to speak on camera at a recent vigil. However, they said they want him remembered as someone who laughed a lot and loved making others smile.
