WASA Wins Court Battle Over TT$2.5 Million Performance Bond

The Water and Sewerage Authority (WASA) has won a Court of Appeal victory against Bankers Insurance Company Limited over a TT$2.5 million performance bond tied to the failed San Fernando East Trunk Sewer project.

The dispute stemmed from a $25.4 million sewer rehabilitation project awarded in 2012, in which the contractors failed to complete the works within the required 180-day period and remained in default months after the deadline.

Bankers Insurance argued that WASA had not proven when the contract began and claimed the bond covered only obligations under the tender documents.

The Court rejected those arguments and agreed with submissions by WASA’s Lead Counsel, Anand Ramlogan SC, finding that the contract documents clearly established the project’s timeline and the contractor’s obligations.

The Court ordered the company to pay WASA $2.5 million, together with interest and legal costs.
