Man accused of assaulting officer at south Lincoln Arby’s allegedly assaults another officer while in custody

LINCOLN, Neb. (KLKN) – The same man involved in an intense altercation at a south Lincoln Arby’s has now allegedly assaulted another officer at the Lancaster County Jail while in custody.

That incident left a responding officer with minor bruises.

“At approximately 10:51 a.m., officers were called to the Lancaster County jail on a report of an assault,” said Lincoln Police Sergeant Chris Vollmer on Friday.

The suspect, 36-year-old Joseph Bertolino, attacked a staff member in the jail’s infirmary on Thursday morning.

The officer was assaulted with “a conducted energy device,” something LPD says is similar to a taser.

“One of the officers had that on their arm and then also suffered some minor abrasions to the head and elbow,” said Sgt. Vollmer.

“He was brought under control and cited for second-degree assault on an officer and remains in the jail’s custody.”

Sgt. Vollmer says it took several staff members to get him under control.

Police first took Bertolino into custody on Tuesday night for an alleged assault on a different officer at the Arby’s at South 27th and Nebraska Parkway.

Police say he grabbed the officer’s firearm, and after it went off into the floor, both Bertolino and the officer were taken to the hospital.

That officer was then treated for non-life-threatening injuries from bullet fragments.

While in custody, Bertolino made what LPD is referring to as concerning comments over a death at the Country Inn and Suites hotel in Carter Lake, Iowa.

Carter Lake Police conducted a welfare check and found a deceased male inside a hotel room. Authorities identified that man as 63-year-old Kenneth Gauff of Omaha.

Bertolino was seen in court on Friday and waived his right to extradition. He will be sent back to Iowa to face a first-degree murder charge.
