PIL seeking Act to shield husbands from persecution dismissed | Prayagraj News

Prayagraj: Allahabad High Court dismissed a PIL seeking direction to govt of India and other respondents to introduce an Act for protection of husbands from persecution and harassment meted out by their estranged wives. The PIL had annexed several news-items highlighting plights of men across the country and avered that existing laws were highly partial to women, emboldening them to harass and persecute men illegally.Dismissing the PIL filed by Chandrama Vishvakarma, division bench comprising Chief Justice Arun Bhansali and Justice Kshitij Shailendra said in a decision dated Sep 24, “Except for reference to certain news items, wholly cursory averments have been made in the petition seeking relief. No case is made out in the petition for entertaining it as public interest litigation.” The petitioner had alleged that women were harassing husbands and implicating them and their family members in fake cases, hence, an Act that checked persecution and harassment of men was need of the hour. The petitioner said he had earlier written to prime minister, Union home minister, Lok Sabha speaker, chairman of Rajya Sabha, governor and chief minister in this regard, but no step was ever taken in this connection, so he filed the PIL in high court. In the PIL, he alleged that more than 90% cases of harassment for dowry were fake, resulting in harassment of husbands and their family members. Even fake cases of rape were on the rise and it was difficult to get divorce as per existing laws, the PIL added.
